The Commission has published Council Implementing Regulation 2017/1570, Official Journal reference L238, amending anti-dumping and countervailing measures on imports of crystalline silicon photovoltaic modules and key components (for example, cells), originating in or consigned from the People’s Republic of China, from 1 October 2017.
The following commodity codes expire on 1 October 2017:
- 8541 4090 21
- 8541 4090 22
- 8541 4090 23
- 8541 4090 29
- 8541 4090 31
- 8541 4090 32
- 8541 4090 33
- 8541 4090 39
The products will then be classified within the following TARIC codes.

The undertaking offered by exporting producers was repealed on 1 October 2017 and replaced as follows.

Neither anti-dumping nor countervailing duty will be collected where the net free-at-Union-frontier price is equal to or higher than the corresponding Minimum Import Prices (MIP) set out in the table below:

Where the net free-at-Union-frontier price is lower than the MIP above, the amount of definitive duties will be the difference between the MIP and the net free-at-Union-frontier prices before duty, capped at the ad valorem (%) rates shown in Annex VI. For example, for B791, the maximum duty is 44.7% anti-dumping duty (ADD) and 3.5% countervailing duty (CVD).
Note. A manual calculation of the duties will be required for the Customs Handling of Import and Export Freight (CHIEF) declaration, where the net free-at-Union-frontier price is lower than the MIP in the table above.
The application of the rates for companies listed in Annex VI and all other companies with reduced ad valorem duty rates is conditional upon presentation to customs authorities of a valid commercial invoice (document code D018) accompanying the company’s sales to the European Union.
Goods not accompanied by this document must pay the full duty rates on customs clearance that apply to all other companies, TARIC additional code B999, 53.4% ADD and 11.5% CVD.
The valid commercial invoice should contain the elements as follows:
- The heading ‘COMMERCIAL INVOICE ACCOMPANYING GOODS SUBJECT TO ANTI-DUMPING AND COUNTERVAILING DUTIES’.
- The name of the company issuing the commercial invoice.
- The commercial invoice number.
- The date of issue of the commercial invoice.
- The TARIC additional code under which the goods on the invoice are to be customs-cleared at the European Union Frontier.
- The exact plain language description of the goods and: * the product code number (PCN) * technical specifications of the PCN * the company product code number (CPC) * CN code * quantity (to be given in units expressed in watt for modules and cells or pieces for wafers)
- The description of the terms of sale, including: * price per unit (watt for modules and cells or pieces for wafers), * the applicable payment terms * the applicable delivery terms * total discounts and rebates
The name and signature of the official of the company that has issued the commercial invoice.
If the document is not available on customs clearance but is obtained later it may be possible to reclaim the balance of duties paid (within time limits).
Where it is found post-clearance, that the actual price paid is below the price shown on the customs declaration and this price is lower than the MIP, a liability to duties will be incurred (please refer to the regulation for details).
Legal entities not listed in Annex VI will not be subject to MIP. They will be subject to ad valorem duties as tabled below.
New exporters in the People’s Republic of China may apply to the Commission to be added to Annex I and VI (subject to meeting conditions). Please see Commission Implementing Regulation (EU) 2017/1570 for details.
