Welcome to a short community update. In this edition, we will give you an update on our latest compensation figures and we will signpost you to the latest regulations which are being laid in Parliament today.

Latest update on compensation claims started so far

Nick Thomas-Symonds, Minister for Cabinet Office, updated Parliament with IBCA’s latest compensation figures earlier today.

  • 113 people have been invited to start their compensation claim
  • 84 people have accepted their invitations and submitted their claim
  • 23 offers of compensation have been made, totalling £34.4m
  • So far 14 people have accepted their offers with more than £13.3m paid in compensation

Second infected blood compensation scheme regulations

Earlier today, the Cabinet Office laid the second infected blood compensation scheme regulations in Parliament. These regulations restate and expand the Infected Blood Compensation Scheme to give IBCA all the powers it needs to make compensation payments to everyone who is eligible. 

Overview

The second regulations include:

  • the approach to how affected people (those who suffered indirectly from contaminated blood through their relationship with an infected person) will be paid compensation. 
  • Supplementary Routes for infected people, and some affected people.

The second regulations also confirm: 

  • which infected people (or their estates) will be eligible for additional compensation as a result of being involved in unethical research. 
  • the criteria for severe health condition awards, exceptional reduced earnings, excess past care costs and other supplementary routes.

The regulations also state that IBCA will take responsibility for support scheme payments by the end of March 2026.

The draft 2025 Regulations are now publicly available. They need to be debated and approved by both Houses of Parliament before they can become law on 31 March 2025.

Our response

We are working through the new regulations to bring all of the routes into our compensation service. We’ll do this as quickly as we can, designing and expanding the service.

We know that if you’ve looked at the published regulations online, the legal language can seem very complicated. As we integrate these into our service, we’ll ensure the language and process are as simple as possible for people claiming compensation. You can also use the government’s explainer as a guide to the regulations.

Transition of existing infected blood support schemes

The regulations also confirm that the existing infected blood support schemes will transfer to IBCA in early 2026. 

We would like to reassure you that your monthly support payments will not be affected, you’ll continue to receive them as you do now. When you transfer to IBCA and start your claim, you’ll have your own dedicated claim manager who’ll support you through every step of the process.
