Habitats Regulations Assessment Advisory Working Group member alongside Lord Benyon, Minister Pow and Tony Juniper as Chair of Natural England.

Terms of reference

The Habitats Regulations Assessment Working Group aims were to consider policy changes to improve the provisions of the Habitats Regulations 2017.

The group focused in particular on Part 6 of the Regulations but their consideration was not limited to those sections and they were encouraged to highlight other failings or areas in need of reform.

Objectives

The group informed policy thinking on the development of proposals for the review of the Habitats Regulation Assessment (HRA) by focusing on identifying:

  • changes that could bring clearer purpose and clarity to the scoping and screening process for protected sites set out in Part 6 of the Habitats Regulations 2017
  • ways to reduce legal ambiguity and to rectify any problems caused by historic EU case law relating to the Habitats Directive and Birds Directive more generally
  • options to develop an assessment process for protecting designated sites from significant harm so that they better reflect the framework and targets set in the Environment Act
