The request was for information about the number of shifts where payments to staff exceeded the price caps and the trusts reporting these payments.

Monitor did hold the information requested and withheld it on the basis of the exemptions in sections 31 and 33 of the FOI Act.

7 July 2016: On internal review, Monitor agreed that the identity of the trusts should not be released, but has published the numbers of trusts who each week, from 23 November 2015 to 9 May 2016, had made such reports.
