Extended Producer Responsibility for Packaging (pEPR) producer data requirements: RPS 330

This regulatory position statement (RPS) does not change your legal requirement to:

Report 2024 nation of sale and self-managed organisational waste data in accordance with the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024 (the Packaging regulations), for the period 1 January to 31 December 2024 or 1 July to 31 December 2024 as appropriate to the Environment Agency on or before 1 April 2025 or 1 December 2025 as appropriate.

Collect 2025 nation of sale and self-managed organisational waste data in accordance with the Packaging regulations for the period 1 January to 31 December 2025.

Report the data from point 2 to the Environment Agency, either on or before 1 October 2025 or on or before 1 April 2026 as appropriate.
The Environment Agency will not normally take enforcement action against you if you do not comply with these legal requirements.
1. Activity this RPS applies to
This RPS applies to producer obligations to collect and report data relating to nation of sale and self-managed organisational waste.
If you are a member of a compliance scheme or group registration, the obligation to report your data falls to your scheme operator or holding company, as set out in the regulations.
This RPS does not apply to any other data collection or reporting obligations under the data or packaging regulations.
2. Things to note
This RPS delays the introduction of nation of sale and self-managed organisational waste data collection and reporting under pEPR until 2026. This will reduce the regulatory burden of data collection and reporting obligations that have no bearing on producer disposal fees and recycling obligations for producers, compliance schemes and holding companies.
Nation of sale and self-managed organisational waste data is for use in determining individual UK nation recycling targets. This data will be of limited value until data from other upcoming legislative reforms is reported.
3. When you must check back
The Environment Agency will withdraw this RPS on 31 December 2026.
The Environment Agency can withdraw or amend this regulatory position if they consider it necessary. This includes where the obligations that this RPS relates to have not changed.
You will need to check back from time to time to see if this RPS still applies.
This RPS remains in force until it is removed from GOV.UK or is otherwise identified as having been withdrawn.
