Energy Price Guarantee for domestic gas consumers in Northern Ireland: Direction No. 1 under Section 22 of the Energy Prices Act 2022 (19 December 2022)

1. Introduction, commencement and interpretation

1.1 This direction:

(a) is made pursuant to Section 22 of the Energy Prices Act 2022 (EPA); and
(b) comes into effect on 20 December 2022 (the Effective Date).

1.2 It may be cited as the Energy Price Guarantee for Domestic Gas Consumers in Northern Ireland, Direction No.1.

1.3 In this direction:

(a) capitalised terms have the meanings given to them in the Energy Price Guarantee for Domestic Gas Consumers in Northern Ireland, Scheme Document, unless indicated otherwise
(b) reference to a quarter day means any of the following days in a year: 1 January, 1 April, 1 July and 1 October; and
(c) the term licensed gas supplier has the meaning given to it in Section 12(6) of the EPA.

2. Direction

2.1 Each licensed gas supplier shall not set a new Tariff or revise an existing Tariff for any Consumer to take effect on a day other than a quarter day unless it has consent (in writing) of the Secretary of State for Business Energy and Industrial Strategy to do so, and has complied with any requirement specified by SoS, when giving the consent, as a condition of the consent.

2.2 This direction does not apply to any new or revised Tariff:

(a)notice of which has been given by a licensed gas supplier to a Consumer before the Effective Date;
(b) that comes into effect after the Scheme End Date.
