1. Written Decision of the Deputy Traffic Commissioner

1.1 RTTS Travel Ltd – an application for Section 19 permits

2. Background

RTTS Travel Ltd (a company limited by guarantee) has applied for 70 permits under Section 19 of the Transport Act 1985 (“the 1985 Act”).

At a public inquiry held in Golborne on 25 January 2023 I satisfied myself that the company is a not-for-profit organisation and that the routes served all fall within the short distance exemption which was added to the 1995 Act by amending regulations made in 2019. The company therefore fulfils the basic requirements to be awarded Section 19 permits.

3. Decision and conditions of grant

I hereby grant the application (albeit for passenger classes B and C rather than A) subject to the following conditions, which the company has indicated that it accepts:

  • vehicles to be given Class V MOTs (including seat belt installation check);

  • vehicles to be maintained as per the Guide to Maintaining Roadworthiness;

  • safety inspections to be carried out at least every 10 weeks;

  • a section to be added to safety inspection sheets enabling the fitter to sign vehicles off as roadworthy;

  • vehicles to have a decelerometer brake test at each safety inspection;

  • all drivers to have a driver Certificate of Professional Competence (CPC).

4. Driver Certificate of Professional Competence

I note that currently most of the drivers do not have CPCs. I have therefore agreed to allow a transitional period until 31 August 2023 during which drivers will gain this qualification in time for the new school year. Thereafter only drivers holding the CPC will drive the operator’s vehicles.

5. Previous temporary permits

The new permits granted replace the temporary permits which the operator currently has. The temporary permits should be returned to the central licensing team in Leeds within 7 days of the issue of the new Section 19 permits.
