1. Written Decision of the Deputy Traffic Commissioner

1.1 Mrs Larraine Davey and Davey Travel Ltd (OG1044801)

Mrs Larraine Davey, director, appeared before me today at a formal hearing in relation to whether she should be disqualified following on from my written decision made on 02 June 2021 regarding OG1044801.

Appearing before me were Mrs Lindsey Bickerton (director) and Mr Keith Davey (proposed transport manager).

Also present was Mrs B Bell CBE, solicitor who represented Mrs L Davey, Mrs L Bickerton and Mr Davey.

Having formally dealt with the instant matter before me I converted the hearing into an impromptu preliminary hearing in relation to the PSV application that I had been made by Davey Travel Limited for an authorisation for 20 vehicles.

2. FORMAL DETERMINATION REGARDING MRS L DAVEY

I am satisfied that she was ignorant of all material facts before the Public Inquiry on 21 May 2021. She left the hearing today without a stain on her character. No further action needs to be taken.

3. APPLICATION FOR A NEW PSV OPERATOR’S LICENCE MADE BY DAVEY TRAVEL LIMITED

I retained custody of this application as per my written decision.

Having heard evidence from the proposed transport manager Mr Keith Davey, and from the directors Mrs Bickerton and Mrs Davey and having accepted two undertakings from Mrs Bickerton and Mrs Davey and after it was confirmed that the application is now out of the objection period I have directed that subject to the application being complete (which I understand it is) and subject to the two undertakings (below) the application is to be granted as applied for with Mr K Davey specified as the transport manager.

My clerk has been instructed to inform the central licensing unit at the Office of the Traffic Commissioner of my decision to grant the application.

A copy of this note is to be added to the case notes for this application.

The undertaking that was given to me by Mrs Davey and by Mrs Bickerton was:

“Before 01 November 2021 Mrs Bickerton (director) and Mrs Davey (director) will have each successfully completed a PSV OLAT course given by a competent, accredited and independent provider and a copy of the certificate for that course will be received at the Office of the Traffic Commissioner within 21 days of the course being completed.”

Finally, Mr K Davey had recently undertaken a two day transport managers CPC refresher training course. A copy of that certificate needs to be received at the Office of the Traffic Commissioner within 14 days of today.
