Ceramic tableware and kitchenware originating in the People's Republic of China (anti-dumping duty 2410)

Amending the list of cooperating companies with lower anti-dumping duty rates for imports of ceramic tableware and kitchenware, originating in the People’s Republic of China.

The Commission, by Implementing Regulations 2020/881 and 2020/882 Official Journal ref. L203, is adding 2 new exporting producers to the list of Annex I cooperating companies. The anti-dumping duty rate applicable to ceramic tableware and kitchenware, originating in the People’s Republic of China, produced by these companies is 17.9%.

These regulations apply from 27 June 2020.

1. Products affected

The products are currently classified within the following commodity codes:

  • 6911 1000 90
  • 6912 0021 11
  • 6912 0021 91
  • 6912 0023 10
  • 6912 0025 10
  • 6912 0029 10

If the importer buys directly from the Chinese exporting producer, the import declaration must be accompanied by the commercial invoice bearing a declaration of the exporting producer as follows:

1.1 Manufacturer declaration for direct export sale

A declaration signed by an official of the manufacturer, in the following format, on the valid commercial invoice:

1) The name and function of the official of the manufacturer.

2) The following declaration:

‘I, the undersigned, certify that the (volume in kg) of ceramic tableware and kitchenware sold for export to the European Union covered by this invoice was manufactured by (company name and address) (TARIC additional code) in the People’s Republic of China. I declare that the information provided in this invoice is complete and correct.’

3) Date and signature

If the importer buys from a trader or other intermediate legal person, whether located in mainland China or not, the import declaration must be accompanied by the commercial invoice from the manufacturer to the trader bearing a declaration of the manufacturer and by the commercial invoice from the trader to the importer, as follows:

1.2 Manufacturer declaration for indirect export sale

A declaration of the Chinese manufacturer, signed by an official of the manufacturer issuing the invoice for this transaction to the trader, in the following format, must appear on the commercial invoice of the manufacturer to the trader:

1) The name and function of the official of the manufacturer.

2) The following declaration:

‘ I, the undersigned, certify that the (volume in kg) of ceramic tableware and kitchenware sold to the trader (name of the trader) (country of the trader) covered by this invoice was manufactured by our company (company name and address) (TARIC additional code) in the People’s Republic of China. I declare that the information provided in this invoice is complete and correct.’

3) Date and signature
