Guidance and notes on the changes to Patents, Trade Marks and Designs forms made as a result of introduction of the ‘forms@ipo.gov.uk’ email address

(a) These notes are not part of the Directions. They are intended to provide background and additional information.

(b) The Interpretation Act 1978 applies to these Directions. Therefore, all the definitions set out in the Registered Designs Act 1949 (as amended), Patents Act 1977 (as amended) and the Trade Marks Act 1994 (as amended) apply to these Directions. Further, amongst other things, generally any words importing the masculine gender include the feminine and words in the singular include the plural and words in the plural include the singular.

(c) Section 31A of the Registered Design Act, Section 123(2A) of the Patents Act and Section 66 of the Trade Marks Act allows the comptroller to give directions specifying any forms the use of which is required by the Designs Rules, the Patents Rules and the Trade Mark Rules.

(d) The following design forms, patents forms and trade mark forms have been revised as set out below.

Designs Form 1A, Designs Form 23, Patents Form 1, Patents Form 3, Patents Form 9A, Patents Form 10, Patents Form 12, Patents Form 14, Patents Form 21, Patents Form 23, Patents Form 51, Patents Form 52, Trade Marks Form 7, Trade Marks Form 16, Trade Marks Form 24, Trade Marks Form 26(I), Trade Marks Form 31R, Trade Marks Form 33

Design Forms 1A, 23, Patents Forms 1, 3, 9A, 10, 12, 14, 21, 23, 51, 52 and Trade Marks Forms 7, 16, 24, 26(I), 31R, 33

(e) These forms have been revised by the addition of the ‘forms@ipo.gov.uk’ email address. The following text will be added to each form: “Send your form(s), saved as PDF(s) to: forms@ipo.gov.uk. For help saving your forms as a PDF see ‘How to file documents with the Intellectual Property Office

(f) This will be added as a standalone box in the case of Patent and Designs forms, or in the case of the Trade Marks forms, be added to the existing “How to Send us your forms” box.

(g) The Payment page has also been revised to remove the duplication of the “Post to” address at the bottom of the page and the reference to this address in the cheque payment section.

Patents Forms 3, 9A, 10, 14 and 52

(h) These forms have been altered to capture the filers name and address details. This consists of the addition of a new section to the following forms:

  • patent Form 3 – section 8
  • patent Form 9 – section 8
  • patent Form 10 – section 6
  • patent Form 14 – section 6
  • patent Form 52 – section 7

These sections now require that the filer of the form provides their name and address, in addition to the currently requested contact details.

Patents Forms 12, 21, 23 and 51

(i) Patents Forms 12, 21, 23 and 51, have had note b amended to the following: “If completing by hand please write in capitals, using a black pen.”

(j) Patents Form 51 has had the reference to fax removed in section 7.

Designs Form 23

(k) Designs Form 23 has had section 7 altered to add the following: “(if completing by hand please write in capitals)”
