Details
Mr Flaherty brought a complaint under section 108A of the Trade Union and Labour Relations (Consolidation) Act 1992 that the Union had breached and/or threatened to breach rules relating to the appointment or election of a person to an office of the Union.
Following a hearing on 15 July 2026, the Certification Officer upheld the Applicant’s complaint but did not find it appropriate to make an enforcement order. The Certification Officer also declined the Applicant’s request to impose a financial penalty on the Union.
