The Breath Analysis Devices Approval (Scotland) 2014

The Secretary of State, in exercise of the powers conferred upon him by section 7(1)(a) of the Road Traffic Act 1988(a), (“the 1988 Act”), hereby approves as from 18 August 2014, as a means by which specimens of breath may be provided for analysis under that section, the device known as the Intoximeter EC/IR manufactured by Intoximters Inc, composed of the Intoximeter EC/IR, the Intoximter EC/IR Gas Delivery System and software version 5.40, for the use of police forces in Scotland.

Explanatory note

(This note is not part of the Approval)

Section 7(1)(a) of the Road Traffic Act 1988 empowers a constable, in specified circumstances, to require a person to provide two specimens of breath for analysis by means of a device type approved by the Secretary of State. This Approval approves as from the 18 August 2014 as means by which specimens of breath may be provided for analysis under the said section 7(1)(a) the device known as the Intoximeter EC/IR.
