Amending regulations that impose anti-dumping or countervailing duties on steel (Anti-Dumping Duty AD2356)

The Commission has announced, in Regulation no. 2019/1382, OJ ref.L227, that where the 25% safeguard duty becomes payable (because the quota is exhausted) on certain steel imports in chapters 72 and 73 of the Tariff, any Anti-Dumping Duty (ADD) or Countervailing Duty (CVD) also in force will be adjusted and suspended as appropriate, with immediate effect.

Description of measures:

  • where the 25% safeguard duty exceeds the higher of the ADD or CVD rates, only the safeguard duty will be collected and the ADD or CVD will be suspended

  • where the 25% safeguard duty is less than the equivalent ad valorem (%) rate of the ADD or CVD, the safeguard duty will be collected and the ADD or CVD rate will be reduced and the balance will be suspended

  • any ADD or CVD suspensions are limited to the period that the 25% safeguard must be paid, it does not apply when the quota is available

  • this regulation takes effect from 4 September 2019

  • these measures do not apply before this date and cannot provide the basis for re-imbursement of duties collected prior to 4 September 2019

  • the ADD or CVD regulations concerned and the adjusted rates are detailed in the Annexes of regulation no. 2019/1382

As a consequence of this regulation the anti-dumping duty on welded tubes and pipes of iron or non-alloy steel originating in Belarus, China and Russia will be reduced and suspended from 4 September 2019 to 30 September 2019 as follows:
