Repeal of section 76B of the Mauritian Criminal Code by the National Assembly in Mauritius
An update on repeal of section 76B of the Mauritian Criminal Code by the National Assembly in Mauritius.
On 28 October 2025, the National Assembly in Mauritius repealed section 76B of the Mauritian Criminal Code, removing the offence of ‘misrepresenting the sovereignty of Mauritius by producing, distributing, supply or marketing any coin, stamp, official map or official object or document’.
Mauritius has published an Explanatory Memorandum for this change: Criminal-Code-Amendment-No.-2-Bill.pdf.
This offence previously applied only to ‘persons acting under the authority or instructions of, or pursuant to a contract with, or with the direct or indirect financial support of, a foreign state’, and no one was ever prosecuted for it.
We welcome repeal of section 76B and the clarity this provides.
