New guidance explains how expert witness costs are assessed and funded in criminal legal aid cases, including prescribed rates and prior authority.

We have published new guidance on the remuneration of expert witnesses in criminal legal aid cases. The guidance explains how expert costs are assessed and funded, including the application of prescribed rates, requests for higher rates, and the prior authority process.

Supporting prior authority applications

The guidance provides information on:

  • obtaining alternative quotations and when these are required
  • assessing associated costs, such as travel expenses
  • the evidence required to support applications

A prior authority checklist is also included to help providers submit complete applications.

The guidance includes a summary of expert witness fee rates for criminal cases, covering both current and historic matters.
