Consultation description

This consultation seeks views on the operation of the whistleblowing framework in the Employment Rights Act 1996 and on options for reforms. It also seeks views on the design of a proposed Serious Fraud Office (SFO) scheme to provide financial rewards to individuals who report economic crime, and on associated criminal offences.

The whistleblowing framework in the Employment Rights Act 1996 applies in England, Wales and Scotland. The SFO, by contrast, has jurisdiction in England, Wales and Northern Ireland, but not Scotland. However, under the proposed incentive scheme, individuals could be eligible for a financial reward regardless of where they are located or where the information originated, provided they meet the scheme’s eligibility criteria.
