Detail of outcome

The Civil Liability Act 2018 changes the way the personal injury discount rate is set. ‘Setting the Personal Injury Discount Rate: A Call for Evidence‘ was published on 6 December 2018. The Call for Evidence period closed on 30 January 2019.

This report summarises the responses received from a broad spectrum of interested parties. The views and material directly informed the advice which the Government Actuary and HM Treasury provided the Lord Chancellor.

Decision on setting the new discount rate

On 15 July 2019 the Lord Chancellor announced the setting of a new discount rate via a Written Ministerial Statement, and placed a Statement of Reasons for his decision in the Libraries of the House of Commons and House of Lords.

On 17 July 2020, the Government Actuary has published the 8th edition of the Ogden Tables which can be accessed on GOV.UK.

The ‘Ogden’ tables help actuaries, lawyers and others calculate the lump sum compensation due in personal injury and fatal accident cases.

Call for evidence description

The Civil Liability Bill is awaiting Royal Assent. When enacted it will change the way the personal injury discount rate is set. In preparation for the first review of the rate under the new legislation the government has published Setting the Personal Injury Discount Rate A Call for Evidence. The response to the Call for Evidence will help the Lord Chancellor in carrying out the first review of the rate under the new legislation.

The Call for Evidence seeks up-to-date data and information on a wide range of topics relevant to the setting of the personal injury discount rate under the provisions of the Civil Liability Bill, including in particular investments available to claimants, investment advice provided to claimants, investments made by claimants and model investment portfolios.
