Based on the response, we have decided that:

  • final claims shall be lodged with the Enemy Property Claims Assessment Panel (EPCAP) Secretariat, under both the Enemy Property and Baltic States Schemes, by 31 March 2023, 12 months from the end date of this consultation

We recognise the problems faced by some potential claimants in obtaining evidence to support claims due to COVID-19, including backlogs caused at National Archives across Europe. To enable claimants to substantiate their claims, we will accept partially completed claims at 31 March 2023 where:

  • an asset has been identified as being available for release
  • a claimant has been identified and evidence provided of their identity and legal entitlement to the asset
  • if claimants are represented by a third party, a power of attorney must have been granted to the representative

We will assess all claims received by 31 March 2023. The existing Panel will the determine them after the closure date.

If you want to lodge an appeal against the Panels’ decision with the Appeals Adjudicator, you can do so after 31 March 2023.

We received 5 responses to this consultation, one of which was blank and treated as a scheme enquiry, the rest being general in their commentary. We are grateful for your responses.

  • the availability of evidence including delays due to COVID-19
  • consideration for the Schemes to operate indefinitely

We would like your views on the final date by which claims should be submitted under the Enemy Property Payment Scheme and the Baltic State Scheme, to enable final claims to be assessed before we close the schemes.
