Right of Trade Unions to access workplaces: application and response forms
How to make, and respond to, applications to the CAC under The Trade Unions (Right to Access Workplaces) Regulations 2026.
The Right of Access provisions come into effect on 30 October 2026.
There is no requirement for the Union and the Employer to copy the access request and the Employer ‘s response to the CAC.
The Union or the Employer can make an application to the CAC if they fail to negotiate an access agreement.
The earliest an application can be made to the CAC where there is no response to a statutory access request is 23 November 2026.
Application forms will be on this site from 16 November 2026 in readiness for an application to be made on or after 23 November 2026.
No application forms will be accepted if submitted before this date.
