Refusal of Section 95 support - definition of destitution and calculation of destitution threshold (including the cost of accommodation) set out. Where there is conflict between the Home Office Instructions to Caseworkers and the Regulations, judges will rely on the Regulations. Regulation 6 of the Asylum Support Regulations 2000 sets out the assets that must be taken into account when determining destitution. Other assets should be disregarded. When assessing property assets, the timescale for realisation of these assets and any bar to their realisation must be taken into account.
