GA v Secretary of State for the Home Department: AS/12/10/29002

Asylum Support Tribunal decision of Judge Verity Smith on 26 October 2012.

Refusal of support under Section 95 on the grounds that the appellant was no longer an asylum seeker. Held that the appellant was eligible for support by application of Section 94(5) and his two minor dependent children despite having had a break in asylum support held that the appellant remained entitled to be treated as continuing to be an asylum seeker and that he only needed to show that he had a dependent child under the age of 18 who formed part of his household and that both he and the child remained in the UK in order to satisfy the wording of Section 94(5).
