Test reapplied when determining whether or not a decision to refuse support is a decision in relation to destitution rather than a refusal to entertain applying Section 57 of the Nationality, Immigration and Asylum Act 2002. Examination of the wording of the decision letter is important. Section 57 does not attract a right of appeal under Section 103 of the Immigration and Asylum Act 1999.
