Asylum Support Tribunal decision of Judge Storey on 7 July 2004.

A person who has ceased to be an asylum seeker is no longer entitled to the provision of Section 95 support (save where Section 94(5) applies). There is no right of appeal. Alternatively, if there is either a decision or appeal pending against the refusal of asylum, an appeal does arise to the Tribunal.

The Tribunal found that the appellant was entitled to appeal against the decision purporting to refuse to entertain his application for support as he had outstanding appeal in relation to his asylum claim.
