Judicial Summary

The Appellant company applied for a restricted licence and was granted an interim licence pending provision of evidence of financial standing. The licence documentation gave the date when the evidence was required and the expiry date and warned that no reminders would be sent. The Office of the Traffic Commissioner did not receive the evidence when required, the interim licence expired and the application was refused. Subsequently the Appellant sent a substantial amount of financial evidence, but it did not constitute evidence over the required 3 month consecutive period. In any event, the licence had already properly been refused on the ground of failure to provide the necessary evidence after the Appellant had been given a proper opportunity to do so.
