Remy Dhami v Secretary of State for Work and Pensions (PIP): [2026] UKUT 371 (AAC)

Upper Tribunal Administrative Appeals Chamber decision by Judge Wright on 29 September 2026.

Judicial Summary

In giving permission to appeal on the issue of whether the First-tier Tribunal (FTT) judge’s questioning of the appellant had been unfair, the District Tribunal Judge referred adversely to the FTT ‘descending into the arena’.

In dismissing the appeal, the Upper Tribunal holds that this was an inapt, indeed wrong,  consideration in the inquisitorial jurisdiction which the Social Entitlement Chamber of the FTT has long exercised. GJ v SSWP (PIP) [2022] UKUT 349 (AAC) and BK v Secretary of State for Work and Pensions (DLA) [2009] UKUT 258 (AAC) applied and endorsed.
