Judicial Summary

This decision concerns young people who undergo the DLA-PIP transfer process and were, as children, entitled to DLA. By operation of law, a DLA appointment made on the basis that the claimant was a child does not have effect in relation to PIP matters. However, the DWP have developed a practice whose aim is to ensure that the transfer process does not inevitably result in young PIP transfer claimants ceasing to have an appointee. The practice is described in the decision.
