Judicial Summary
Traffic Commissioner commenced public inquiry at the listed time of 10.00, when the operator was not in attendance. He telephoned at 10.05 to say he would be at the hearing in fifteen minutes. The TC allowed 15 minutes and then concluded the hearing. Operator attended before 10.30 and TC refused to set aside decision and re-open case. UT determined that a little more leeway should have been given to an operator who was on his way and the TC’s decision was not proportionate or fair.
