Judicial Summary

Operator’s licence granted despite significant compliance failings during the currency of an interim licence. Significant compliance failings continued, the company was operating in conjunction with another, with control of the vehicles and drivers in the hands of the other operator’s client. As a result of Mr Singh’s failure to comply with directions re production of documentation and his failure to attend an adjourned hearing, the licence was suspended until documentation produced. He continued to operate all of the vehicles during the period of suspension for 16 days and then prevented his external transport manager from accessing the data which showed unlawful operation. Mr Singh was found to be untrustworthy in all respects. Loss of repute and revocation of licence was inevitable and a long period of disqualification justified. Both Appellants disqualified for 7 years which was neither disproportionate or plainly wrong.
