Judicial Summary
The Upper Tribunal concluded for the purposes of section 4(5) of the Act that there were no mistakes of law in the Disclosure and Barring Service Decision to include the Appellant on the Vulnerable Adults’ Barred List (ABL). There were no material mistakes of fact upon which the Decision was based – there were some mistakes of fact but it is inevitable that the DBS would have reached the same conclusion even if it had not made these mistakes.
The Decision of the DBS to include the Appellant on the ABL was confirmed.
The appeal was dismissed.
