Whether regulation 27 of the Personal Independence Payment Regulations can be disapplied or read under the Human Rights Act 1998 so as to allow the enhanced rate of the mobility component of Personal Independence Payment to be awarded after pensionable age in the case of a terminally ill person who had an award of the standard rate of the mobility component before he reached 65.
