Judicial Summary

The First-tier Tribunal (FTT) held a remote telephone hearing of the Appellant’s Personal Independence Payment (PIP) appeal. The Appellant’s representative also attended remotely, but was unable to take part in the hearing for at least 15-20 minutes due to technical difficulties. The Appellant appealed on two grounds, being (1) procedural irregularity and breach of natural justice; and (2) the FTT’s treatment of PIP daily living activity 9 (engaging with other people face to face). The Upper Tribunal allowed the Appellant’s appeal on both grounds and remitted the case for re-hearing.
