Judicial Summary
The Applicant was concerned that personal data had been erased from a hospital data record system. He made a complaint to the Information Commissioner. Dissatisfied with the Commissioner’s response, he applied to the First-tier Tribunal for an order under section 166 of the Data Protection Act 2018. The FTT struck out the application as having no reasonable prospects of success. The Applicant then applied to the Upper Tribunal, which refused his application for permission to appeal.
