Judicial Summary
This is a decision about Regulation (EU) 1151/2012 on quality schemes for agricultural products and foodstuffs. This is retained or assimilated EU law in Great Britain. The appeal concerns a decision of the respondent to approve an application by Salmon Scotland for a non-minor amendment to the Scottish Farmed Salmon Protected Geographical Indication to change that PGI from “Scottish Farmed Salmon” to “Scottish Salmon”. Animal Equality appealed that decision to the First-tier Tribunal. The FTT did not err in law in deciding that under Article 6(1) of Regulation (EU) 1151/2012 the phrase “likely to mislead the consumer as to the true origin of the product” was limited to misleading consumers about the country and region of the product and does not cover misleading consumers about the methods of production of the product.
