A new export licence is needed if dual-use items are being exported from the UK to the EU or the Channel Islands, issued by the UK. However, the conditions of this new licence allow 30 days from the first use to register with DBT.

If DBT assess the goods as controlled but the OGEL (Export of Dual-use items to EU Member States) may be used, goods can be released for export and the exporter issued with the letter below advising them of the need to register for the OGEL within 30 days.

Licence Required – OGEL (Export of Dual-use items to EU Member States)

Dear Sir,

I refer to the consignment of xxxxx which was detained at xxxxx on xxxx, we must advise you that these goods have been rated as ‘Licence Required’ (Insert rating here), It may be possible to export some of the goods under the OGEL (Export of Dual-use items to EU Member States) provided that all the terms and conditions contained therein are fulfilled and complied with.

If you are not yet registered to use the licence the goods will still be released for export. Please note, you now have 30 days from the date of this letter to register for the licence. This can be applied for and used following registration on SPIRE, the online export licensing system.
