SPM130800 - Statutory Adoption Pay (SAP): general information - entitlement to SSP during Adoption Pay Period (APP)

An employee who is entitled to SSP in any week during the APP cannot get SAP for that week. An employee can be paid SAP while they are serving their waiting days for SSP.

If they become sick before the start of the intended adoption leave, the child will not normally be placed with them until they are well. They will need to tell their employer the new start date for leave and pay.

If they tell their employer they are incapable of work during their APP and they are entitled to SSP, they will get SSP instead of SAP. If they stop being incapable of work during the 39 week APP, payment of SAP should continue until the end of the 39th week.
