Roles and Responsibilities: The Department for Environment, Food and Rural Affairs and Scottish/Northern Irish equivalents
England and Wales
The Department for Environment, Food and Rural Affairs polices and enforces Agricultural Wages Orders made by the Agricultural Wages Board (NMWM02050). It also enforces the national minimum wage in the agricultural sector.
Advice and guidance concerning the provisions of the Agricultural Wages Orders is provided by both the Pay & Work Rights Helpline (NMWM02045) and the Agricultural Wages Helpline. Specific complaints of underpayment are handled by the Agricultural Wages Team. If a complaint cannot be resolved through negotiation it is passed to an Agricultural Wages Inspector who has the authority to take enforcement action.
The Agricultural Wages (Scotland) Act 1949 requires Ministers of the Scottish Executive to ensure compliance with the terms of the Agricultural Wages (Scotland) Orders made by the Scottish Agricultural Wages Board (NMWM02050). Enforcement work is carried out by officers appointed by Scottish Ministers.
The Department of Agriculture and Rural Development deals with enforcement of Orders made by the Agricultural Wages Board for Northern Ireland (NMWM02050).
