Legislation: Powers and safeguards - powers under CTA

The specific powers in the Counter Terrorism Act 2008 relate to the MSBs we supervise only. They do not apply to HVDs, ASPs or TCSPs. They include powers to request information or documents and powers of entry to premises and inspection of documents.

They differ from the MLRs and Transfer of Funds Regulations because we can require information as well as documents under Counter Terrorism Act 2008 and the attendance of, relevant and connected persons. Under the MLR and Payment Regulations our powers do not extend this far.

Visits to businesses under the CT Act 2008 will be carried out when we visit to ensure compliance with MLR 2007 and the Transfer of Funds Regulations 2006.

Further details regarding the powers and safeguards under CTA will be included in Notice MLR8
