IHTM25537 - AR/BR 100% relief allowance: transfer of unused allowance - how the amount to be transferred is calculated

The transferred allowance is expressed as a percentage of the deceased’s unused relief allowance.   

The first step is to calculate the unused 100% relief allowance on the death of the first spouse or civil partner.  This is the difference between the total 100% relieved amount and the final allowance amount at the date of death.   

The total 100% relieved amount is the amount by which the chargeable transfers made by the deceased are reduced by 100% business property or agricultural property relief. This applies to all chargeable transfers made by the deceased in the seven-year period ending on the date of death.   

The final allowance amount is the amount of the 100% relief allowance in effect at the date of death.   

If the deceased used £800,000 of their 100% relief allowance and at the date of their death the final allowance amount was £2.5 million, the unused portion is:   

£2.5 million - £800,000 = £1.7 million  

This unused portion of the 100% relief allowance must then be converted to a percentage.   

Percentage = (unused portion ÷ maximum allowance) × 100   

£1.7 million ÷ £2,500,000) × 100 = 68%   

This percentage is then applied to the survivor’s 100% relief allowance as at the date of their death to calculate the survivor’s additional allowance.   

Survivor’s additional allowance = 68% × £2,500,000 = £1.7million   

Total allowance available   

Survivor’s own allowance (£2.5 million) + transferred allowance (£1.7 million) = £4,200,000 total 100% agricultural or business relief allowance
