Part 5, Chapter 1 of the Digital Economy Act

  • Public service delivery- Section 35 (1)-(12) allows disclosure of information to improve public service delivery. This extends to England, Wales and Scotland.
  • Gas and Electricity- Section 36 (1)-(11) allows disclosure of information to gas and electricity suppliers. This extends to England, Wales and Scotland.
  • Water and Sewerage - Section 38: (1)-(4) allows disclosure of information to water and sewerage undertakers. This extends to England and Wales.

Section 42 (1- 5) prohibits the onward disclosure of HMRC information under sections 35, 36 or 38 without HMRC’s consent.

The legislation is permissive, even if a legal gateway is in place, HMRC will need to consider cost implications and ensure that the disclosure complies with data protection legislation.
