DMBM680730 - Ordinary cause: Notice of intention to defend intimated

Where the defender intends to defend the action he must complete the notice of intention to defend (court form O7).

The defender has at least 21 days from the date on which the service documents were executed to return his notice of intention to defend to the court along with the appropriate court fee (DMBM680560).

Some courts will let you know if a defender has lodged a notice of intention to defend (court form O7) others will not. You will need to find out what the local practice is for your particular court.

Where appropriate, on the first working day following the expiry of the period of notice you should telephone the court to ascertain whether or not the defender has lodged a notice of intention to defend (court form O7) (DMBM680090).
