Application of Section 89 Trade Marks Act 1994: Disclosure of information

Neither the Trade Mark Act nor the SI provides for disclosure to the right holder (normally the right holder already has this information and must disclose it in the application). It may be reasonable to allow the right holder to view a representation of the marks attached to the detained goods (which may be supplied in the form of a digital image) to ensure that they are actually infringing but no other information can be passed to them.
