Post-Detention Action: Offence action

As goods must normally be referred to a court for determination of infringing status and subsequent enforcement of the IP right infringed, Customs offence action in respect of the infringement is not appropriate. This would not preclude offence action being taken for other customs offences related to the consignment, if this would be proportionate and appropriate.
