Ex-Officio detention: Action to be taken where an application for action is not received or is not accepted

The detention or suspension of release of the goods for IPR purposes will cease where:

  • an application has not been received after three working days have elapsed
  • the right-holder declines the offer of intervention at any time
  • an application is lodged by the right holder within the three working days but is not of an acceptable standard and is therefore rejected by the IPAU.

Goods shall be released subject to the completion of all other customs formalities.
