Glossary: Grey market or parallel traded goods

The unauthorised sale of new branded products diverted from authorised distributors in one market to the home market without the knowledge or consent of the right holder.

Such trade is not subject to control under Council Regulation 1383/2003 but can be restricted under certain circumstances under both EU and UK law. Please note however that whilst manufacturing overruns are sometimes described as grey market goods the manufacture and sale of such items is a breach of intellectual property right (normally trademark) and as such are subject to action under the Council Regulation.
