Retirement relief

The relief provided an effective exemption for a certain amount of gains on disposals of all or part of a qualifying business, including certain share disposals. It was replaced by the business asset rate of taper relief which was available from 1998-99 to 2007-08, see CG17895+. Certain elements of retirement relief are reflected in entrepreneur’s relief which is available for disposals on or after 6 April 2008, see CG63950+.

FA98/S140 provided for the phasing out of retirement relief from 6 April 1999. The amounts of gains qualifying for relief was reduced annually in equal stages for the years 1999-00 to 2002-03, so that the relief ceased to be available from 6 April 2003.

Guidance on retirement relief is no longer included in this manual. If you need to consider the deleted guidance then this is available from commercial tax information packages or directly from Capital Gains Technical Group.
