System leadership designations: privacy notice

1. Who we are

We are the school improvement and system leadership division, a part of the Department for Education (DfE).

The DfE controls the personal data processed for the system leadership designations.

2. How we use your information

If you apply to be a system leader, we will receive your personal data through the Rightnow system and process it to manage the designated system leadership roles. This includes:

  • application stage
  • designation
  • withdrawal
  • de-designation

Your name and school name will be published on GOV.UK if you’re designated as a system leader.

3. The personal data we use

The personal data we use includes:

  • name
  • contact details
  • date of birth
  • gender
  • Teacher Reference Number (TRN) if you have one

4. Why this use of data is lawful

For our use of your personal data to be lawful, we need to meet at least 1 condition in the data protection legislation.

For the purpose of this project, the condition is that processing your data is necessary for the exercise of a function of the Secretary of State or the department, as stated under GDPR Article 6(1)(e).

5. Who your data will be available to

We sometimes need to share your personal data for specific purposes. When we need to share your data with others, we ensure that it complies with data protection legislation.

For the purpose of this project we need to share your personal data with:

  • Teaching School Council representatives and their teams
  • on occasion, DfE-contracted external assessors - this is so they can manage the delivery of DfE school improvement commissions

6. How long we will keep your data

By law, we can permanently keep personal data gathered from applications for system leadership designations for research and statistical purposes.

We will permanently keep your name and date of birth to manage any future re-applications, complaints and provision of data for internal reporting processes if:

  • your application is unsuccessful - your contact information will be kept for 5 years and then securely destroyed
  • you withdraw from the designation or are de-designated - your contact information will be kept for 1 year

Personal contact information provided for referees to support applications will be kept for 1 year.

7. Your data protection rights

You have the right to:

  • request access to the information we hold about you
  • have your personal data corrected if it’s inaccurate or incomplete
  • ask that we delete or remove your personal data if there is no compelling reason we should still have it
  • restrict us from processing your personal data (for example, permitting its storage but no further processing)
  • object to direct marketing (including profiling) and processing for the purposes of scientific or historical research and statistics
  • not be subject to decisions based on automated processing where it produces a legal or similarly significant effect on you

8. The right to lodge a complaint

You have the right to raise any concerns with the Information Commissioner’s Office (ICO).
