We received a request under the Freedom of Information Act 2000 (FOIA) for the following information:

  1. Details of the Immigration & Nationality Department (‘IND’) policy or practice adopted or instructions issued or advice given to its staff relating to the order in which IND deals with cases under its ‘One-Off Exercise’ of granting indefinite leave to remain (‘ILR’) to certain asylum-seeker families (announced in October 2004) and in what order cases are selected for (a) having questionnaires issued or (b) consideration once the questionnaire is returned. For example, are cases dealt with in date order of asylum claim or date of application?

  2. Has IND departed from the policy/practice/instructions/advice referred to in paragraph 1 in any individual cases and, if so, in how many cases has this been done and what were the reasons for doing so in those cases?
