St Kitts and Nevis: nationality

St Kitts and Nevis: legitimacy

This section gives HM Passport Office operational staff information about legitimacy in St Kitts and Nevis.

Legitimacy

St Kitts and Nevis legitimacy laws changed on 8 November 1983.

Before 8 November 1983, St Kitts and Nevis recognised a difference between legitimate and illegitimate births.

A child was considered:

  • legitimate if:
    • the parents were married at the time of the birth
    • the parents marry after the birth
  • illegitimate if the parents never marry

Since 8 November 1983, St Kitts and Nevis do not recognise a difference between legitimate and illegitimate births. All births are considered legitimate whether their parents are married or not.

Adoption is legal in St Kitts and Nevis. Foreign nationals must be resident or domiciled in St Kitts and Nevis to adopt.
