We have a received a request under the Freedom of Information Act 2000 concerning:

“The “authorised purposes” defined in section15(4) of RIPA include retaining “material necessary to ensure that a person conducting a criminal prosecution has the information he needs to determine what is required of him by his duty to secure the fairness of the prosecution.”

In the Interception of Communications Code of Practice, section 7 deals with disclosure to ensure fairness. At section 7.9 there is a reference to “material of possible relevance” Do the safeguards cover a definition of possible relevance?

Without sight of the section 15(13) safeguards it is impossible to understand the code of practice.

I would like to find these “Safeguards” or locate them, can you help me because it seems to me that nobody actually knows in detail what these safeguards are.”
