RPC opinion: oversight of higher education delivery partners

The proposal aims to strengthen oversight of franchised provision in higher education.

The Regulatory Policy Committee (RPC) gave a ‘green’ rating to the options assessment for the policy proposal on 27 January 2025. This means that we considered it to be ‘fit for purpose’ based on our scrutiny of the evidence and analysis supporting the case for why regulation is necessary.

The RPC’s opinion refers to the evidence and analysis presented in the assessment, not the policy itself.

Following issue of the RPC’s opinion, the government published The Education (Student Support) (Amendment) Regulations 2026 impact assessment dated April 2026. 

Under the Better Regulation Framework, the Department for Education is not required to submit this impact assessment to the RPC for further independent scrutiny.

The Department for Education has informed the RPC that the impact assessment was updated to reflect that the Office for Students now publishes data on its Subcontractual Partnership Student Outcomes Dashboard.
